Cancillería Insights: Criteria Monitoring #3 – Hidden Rules at US Consulates (Miami & NY)

Welcome to the third edition of our Cancillería Insights series.
While applying for a Colombian visa from abroad is generally the safest route right now, doing so through United States consulates has recently become a minefield of unwritten rules. At Colombian Passport, we process dozens of applications through the US every month, and our internal case committee has detected two major shifts in how the New York and Miami consulates are operating.
If you are a US citizen or resident planning to apply through either of these offices, pay close attention to avoid losing time, money, and your peace of mind.
New York Consulate: The In-Person Interview Trap
Historically, being called for an in-person interview at a Colombian consulate was a rare exception, usually reserved for highly complex cases. However, we are currently seeing that almost every visa application processed through the New York Consulate is triggering a mandatory in-person visit requirement.
What used to be an exception now appears to be the rule.
The Impact on Your Strategy: If you select the New York consulate for your visa study, you must factor this into your logistics. Do not leave the New York area during the 30-day visa study period, or at the very least, be fully prepared to travel back to the consulate on a day's notice. Missing this appointment can result in the abandonment or rejection of your application.
Miami Consulate: The Strict Jurisdiction Check
The consulate in Miami has started systematically issuing "requirements" (requests for additional documentation) asking applicants to upload their US Driver's License.
Why? They are rigorously verifying that the applicant actually resides within their specific consular jurisdiction.
The Impact on Your Strategy:
Be proactive: At Colombian Passport, we are now attaching the driver's license from day one for all our Miami applications. This preemptive move avoids unexpected requirements that delay the process and cause unnecessary anxiety for our clients.
The Jurisdiction Risk: If your driver's license is not from a state within the Miami consulate's jurisdiction, they will not accept your visa application. If you try to "game the system" by applying in Miami while living elsewhere, you will lose 30 days of processing time and forfeit your $54 USD government study fee.
"The team of lawyers at Colombian Passport provided excellent service in processing my Colombian M Visa! From my very first consultation with the lawyer, Camila, she immediately conveyed a great sense of professionalism, friendliness, experience, and expertise. They delivered on everything exactly as planned from the start, guiding me effectively through every stage. We achieved the desired outcome, and I am very pleased. I will be recommending them to any friends or family members who need assistance with immigration procedures or legal advice." — Mario del Petre
