Constitutional Rights vs. Visa Law: The Pensionado Health Insurance Conundrum

Colombian immigration law, governed by Resolución 5477, is clear about the requirements for a Migrant Pensioner Visa (Type M). However, we are increasingly seeing a direct conflict between the visa process and the client's fundamental rights under the Colombian Constitution.


The Health Care Dilemma


The law regarding the Pensionado Visa states that the holder cannot be affiliated with the Colombian public healthcare system (EPS). Yet, the Colombian Constitution mandates that all residents must be affiliated with the EPS under the appropriate regime (Contributory or Subsidized).


This contradiction has led to inadmissibility notices for clients:


  • The Inadmissibility Trigger: A client receiving a steady pension that exceeds the national threshold was incorrectly listed under the Subsidized health regime (designed for vulnerable citizens). This inconsistency was seized upon by the visa officer as grounds for inadmissibility.

  • The Visa Officer's Interpretation: The Ministry's position is that the visa type prohibits any affiliation, a reading that directly contradicts the constitutional right to health care for a resident.


Our Strategy for Legal Resolution


When facing such a legal deadlock, we have a clear hierarchy of action:


  • Correct Administrative Error: First, we immediately work to correct the client’s EPS affiliation to the Contributory regime, addressing the official's concern about the Subsidized status.

  • Formal Legal Argument: If the Ministry still objects, we submit a formal legal complaint (Derecho de Petición) arguing that the client's constitutional right to health care and their obligation as a resident override the Ministry’s interpretation of the immigration law.

  • Constitutional Action (Tutela): Should all administrative avenues fail, we engage constitutional law experts to file a Tutela, a rapid legal action to defend the client's fundamental rights against bureaucratic blockages.
