Cancillería Insights: Criteria Monitoring #2 – Student Visas for Spanish Courses

Welcome to the second edition of our Cancillería Insights series.


First, a quick point of order: when we launched this series, the intention was to provide a "weekly" monitoring update. However, the sheer volume of cases we’ve been successfully managing at Colombian Passport over the past few weeks has kept our team working around the clock. Therefore, rather than holding ourselves to an artificial weekly deadline, I am making a more practical commitment to you: whenever we detect a significant, unwritten shift in how the Ministry of Foreign Affairs (Cancillería) is evaluating cases, we will release an update.


Our goal remains the same: to pull back the curtain on the government's discretionary evaluation criteria and provide you with the preventive strategy needed to protect your legal status in Colombia.


The New Hurdle: V-Type Student Visas for Spanish Courses


Over the past few weeks, our internal case committee has identified a strict and unannounced trend regarding the Type V - Student Visa, specifically for foreigners looking to study Spanish at local institutes or universities.


While Resolution 5477 technically allows foreigners to apply for a student visa to learn Spanish, Cancillería is currently denying or issuing inadmissibility notices for applicants who apply for this specific visa while physically present in Colombia.


What is happening behind closed doors?


The Ministry is heavily exercising its discretionary power. If you are already inside Colombia as a tourist and attempt to transition to a Student Visa for a Spanish language course, officials are blocking the applications. I think that the unwritten expectation is that language students must secure this visa from a Colombian Consulate abroad before entering the country.


Who is affected?


  • Digital Nomads or Tourists currently in Colombia who decided to extend their stay by enrolling in a Spanish academy.

  • Foreigners trying to adjust their migratory status from inside the country using language studies as their primary activity.


The Strategy: Protect Your Stay


If you are already in Colombia and were planning to apply for a Spanish Student Visa, pause immediately. Submitting your application now will likely result in a "inadmisión",


Your current options:

  1. Consular Application: You may need to leave Colombia and apply through a consulate in your home country or a neighboring country (though consular jurisdictions are also becoming stricter).

  2. Alternative Visa Pathways: Depending on your income and professional background, you might qualify for a Digital Nomad Visa, an Investment Visa, or a Rentista Visa, which can be successfully processed while you are in Colombia.
