REQUIREMENTS
General Requirements
Passport: Copy of the main passport page showing all the holder's details; the passport must have a minimum validity of 6 months.
Digital Photo: Color digital photo with a white background, 4 centimeters high by 3 centimeters wide. You must be facing the camera, and your head should be centered and fully visible. Both eyes must be open, and ears must be visible. There should be no glare in the photo, and hair or other accessories must not cover your face. The image format must be JPG with a maximum size of 300 KB. NOTE: The photo must be recent and different from the one in your passport, previous visas, and past applications.
Immigration Status: If the applicant is in Colombia at the time of applying for the visa, a copy of the latest entry or exit stamp from Colombia, extension of stay, or safe-conduct pass for a visa application (whichever applies).
Specific Requirements
Pension Certification: Certification proving monthly pension payments to the applicant, with an amount not less than three (3) current legal monthly minimum wages in Colombia (approximately $1,450.00 USD). This certification must be issued by the competent authority or by the accredited diplomatic or consular mission in Colombia from the country where the pension is received. It must be issued no more than 3 months before the visa application and must be apostilled or legalized as necessary. If it is in a language other than Spanish, it must be officially translated into Spanish.
Criminal Background Check: A judicial, criminal, or police background certificate issued by the authority of the country where the applicant has resided for the last three (3) years, with an apostille or legalization and an official translation.
Medical Certificate: A medical certificate issued by a Colombian authority or by the health authority of the country of origin, confirming the physical and psychological fitness of the applicant.
Health Coverage: Proof of health coverage in Colombia, or a health insurance policy covering risks such as accidents, illness, maternity, disability, hospitalization, death, or repatriation, for the duration of the stay in Colombia.
GOVERNMENT COSTS
Visa Study Fee: $54 USD (paid at the time of application).
Visa Issuance Fee: $270 USD (paid when the visa is approved).
Foreigner ID Card (Cédula de Extranjería): $294,000 COP (paid when picking up the ID card).
OTHER COSTS
Insurance: Depends on the company and your age. Approximately $600 to $800 USD annually.
FBI Background Check (If in Colombia): You will need fingerprinting services, fingerprint shipping, certificate generation, and an apostille. Everything costs approximately $480 USD if you are in Medellín.
FBI Background Check (If in the US): You will only have to pay for the certificate ($30 USD) and the apostille (around $160 USD).
Translations: Depends on the provider and the number of pages to be apostilled, but calculate approximately $20 USD per page for about 4 pages.
APPLICATION AND PROCESS
First of all, I want to let you know that you do not need a lawyer to apply, and you can apply from anywhere because the process is online through the Government's SITAC platform. To apply, you must ensure you have all your requirements ready and have paid the study fee, which is also done online.
You will find that the platform is not user-friendly at all, and you will need to arm yourself with patience and time to master it, but after a while, it is possible to figure it out.
Once you successfully apply, the government has 30 days to review your application and give you a response. The possible responses are:
Requirement: It is very common for them to ask for corrections or ask questions. You must pay attention to your email because you will only have 10 days to respond.
Inadmission: They do not approve the application, theoretically because something was wrong with the requirements. Whether or not explanations are provided will depend on the consulate you selected in your jurisdiction (if you are in Colombia, it will be Colombia), because each one is different. Colombian law gives them discretionary power to approve or deny, and to provide a response or not. You can apply again, but you will have to start from scratch and pay the study fee again.
Rejection: The government has decided to reject your application, and you will not be able to apply again for 6 months.
Approval: You have succeeded, and they will grant your visa. They will give you a code to pay the Visa issuance fee. Once you pay, you will receive an e-visa in your email. You must then proceed to register that e-visa and request an appointment to obtain your Foreigner ID card at Migración Colombia in less than 15 days. That is another very difficult platform to use, but with patience and time, you will learn.
WHY HIRE A COLOMBIAN IMMIGRATION LAWYER
Basically, because the bureaucracy, the poor usability of the platforms, the varying interpretations of requirements, and the discretion of the officials mean that submitting a Visa application in Colombia requires a level of experience, technical knowledge, and legal understanding that a foreigner has no reason to possess.
It is very likely that your first or second application will be inadmitted, and by then you will have already invested $100 USD in study fees and $160 USD in apostilles that you will have to pay again.
But most importantly, you will have lost between 2 and 3 months, and if you are already in Colombia, you run the risk of not being able to apply within the country and having to leave Colombia due to the expiration of your tourist permit.
The frustration and stress involved in doing this process alone are so great that I do not recommend it to anyone—not even to the most tech-savvy person or a foreign lawyer.
A Colombian immigration lawyer, any of us, can provide you with that knowledge and experience so that the process is more agile and without setbacks. Although there may be requirements and inadmissions, you can rest assured that someone is in charge.
